Welcome to GearVibe Swap. These Terms of Service ("Terms") constitute a legally binding agreement between you and GearVibe Swap regarding your use of our platform, services, and website. By accessing or using GearVibe Swap, you agree to be bound by these Terms.

Listing and Trading Rules

Prohibited Items

You may not list, sell, or trade the following items on GearVibe Swap:

• Counterfeit or replica items
• Stolen goods or items obtained through illegal means
• Items that violate intellectual property rights
• Hazardous materials or items that pose safety risks
• Items that violate applicable laws or regulations
• Non-sports equipment or unrelated items

Listing Requirements

When creating a listing, you must:

• Provide accurate descriptions and condition assessments
• Upload clear, authentic photos of the actual item
• Set fair and reasonable prices
• Respond promptly to inquiries from potential buyers
• Complete transactions in good faith

Transactions and Payments

GearVibe Swap facilitates connections between buyers and sellers but is not a party to transactions. All transactions are between users, and we are not responsible for:

• The quality, safety, or legality of items listed
• The accuracy of listings or user-provided information
• The ability of users to complete transactions
• Payment processing or disputes between users

Users are responsible for negotiating terms, arranging payment, and handling shipping or delivery. We recommend using secure payment methods and maintaining records of all transactions.

User Conduct

You agree not to engage in any of the following prohibited activities:

• Harass, threaten, or abuse other users
• Post false, misleading, or fraudulent information
• Interfere with or disrupt the platform's functionality
• Attempt to gain unauthorized access to our systems
• Use automated systems to scrape or collect data
• Impersonate others or misrepresent your identity
• Violate any applicable laws or regulations
• Engage in any activity that could harm our platform or users

Intellectual Property

The GearVibe Swap platform, including its design, features, and content, is protected by copyright, trademark, and other intellectual property laws. You may not:

• Copy, modify, or distribute our platform or content without permission
• Use our trademarks or logos without authorization
• Reverse engineer or attempt to extract source code
• Create derivative works based on our platform

You retain ownership of content you post on our platform, but you grant us a license to use, display, and distribute that content in connection with operating and promoting our services.

Disclaimers and Limitation of Liability

GearVibe Swap is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that:

• The platform will be uninterrupted, secure, or error-free
• Defects will be corrected
• The platform is free of viruses or harmful components
• Listings are accurate or items are as described

To the maximum extent permitted by law, GearVibe Swap shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses resulting from your use of our services.

Indemnification

You agree to indemnify, defend, and hold harmless GearVibe Swap, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with your use of our services, your violation of these Terms, or your violation of any rights of another party.

Termination

We may terminate or suspend your account and access to our services immediately, without prior notice or liability, for any reason, including if you breach these Terms. Upon termination:

• Your right to use the platform will immediately cease
• We may delete your account and associated data
• Any pending transactions may be cancelled

You may terminate your account at any time by contacting us or using account deletion features in your settings.

Dispute Resolution

If you have a dispute with another user, we encourage you to resolve it directly with that user. GearVibe Swap is not obligated to mediate disputes but may provide assistance at our discretion.

Any disputes arising from these Terms or your use of our services shall be resolved through binding arbitration in accordance with applicable arbitration rules, except where prohibited by law. You waive any right to participate in a class-action lawsuit or class-wide arbitration.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the appropriate courts.

Changes to Terms

We reserve the right to modify or replace these Terms at any time. If a revision is material, we will provide at least 30 days' notice prior to any new terms taking effect.
